Workplace Safety
FCB has a Safety Team comprising of lawyers with specialist expertise in the area of occupational health and safety compliance and coronial inquests. Over the years, the FCB Safety Team has partnered with a number of major Australian corporations to assist them with their workplace health and safety needs.
Solutions
- FCB successfully defended a large energy client against OHS charges brought by the Victorian WorkCover Authority in the LaTrobe Valley Magistrates Court, including recovery of their legal costs
- FCB was extensively involved in all legal aspects arising from a workplace fatality at a clientÂ’s steel and resource extraction site. We provided advice in relation to the police and WorkCover investigation as well as represented our client both at the Coronial Inquest and related WorkCover prosecution proceedings
Results
- Our client in Victorian Magistrates Court proceedings was cleared of all charges in full. They were also successful in recovering their costs against the Victorian WorkCover Authority
- Through partnership with FCB, our clients have been able to minimise legal and media exposure in connection with serious OHS incidences in at work sites and workplace fatalities
